I am writing on behalf of the Emergency Department physicians and other physician leaders at Fallbrook Hospital in response to the article by Tom Pfingsten published in the 3/23/05 edition of the NC Times.

David Marguiles, the attorney for the family who is referenced in this article, has misstated and misrepresented the facts relating to the care that was provided to Mr. Hayes while he was in the Emergency Department at Fallbrook. These libelous statements and misrepresentations defame a fine colleague and emergency medicine specialist, Dr. Rene Loya.
