As President and Vice President of the Board of Directors of FPUD, we would like to apologize for the Letter to the Editor by Director McPhee (May 26, Needy FPUD ratepayers should be helped).
McPhee quotes Public Utility Code section 12811.2 and claims FPUD “ignores state law.”
FPUD is governed by Division 7 of the Public Utility Code (the Public Utility District Act) sections 15501-18055. The section McPhee quotes is from Division 6 of the Public Utility Code (the Municipal Utility District Act), it does not pertain to FPUD. Our legal counsel, the General Manager and the Board have tried to explain this to McPhee on numerous occasions. He refuses to listen.
Additionally, FPUD does have a program in place to make payment arrangements with customers who are having problems paying their bill. However, as we have also tried to explain several times to McPhee, State law prohibits us from having a reduced rate for customers based on income or ability to pay.
We ask that the ratepayers not judge the entire Board by the actions of McPhee. We will continue to try to educate Director McPhee.
