SAN DIEGO - A state appeals court today reversed the felony conviction of a medical marijuana dispensary manager who was found guilty of possessing and selling the drug for profit.
Jovan Jackson, 34, was convicted in 2010 and sentenced to six months in jail.
The 4th District Court of Appeal ruled that the trial court erred by not allowing Jackson to argue that his conduct was permitted under California law.
Jackson's case will be sent back to San Diego Superior Court, where he could be tried again, unless the state Supreme Court intervenes.
